Employment and Labor

In the workplace, we’re known as stellar problem-solvers. We analyze employment contracts, navigate compliance issues and assess risk for employers. We’re expert in resolving sexual harassment and discrimination cases too, having successfully freed employers from unjust accusations.

We’re often called upon to present complex issues to executive and legislative bodies and we employ those same skills when negotiating a fair and equitable settlement in discrimination cases.

We have solved numerous Fair Labor Standards Act issues for multiple clients over the past twenty-five years.

Simply put, when clients find themselves painted into an office corner, we turn them around.

Case Study

The Whitehead Law Firm successfully represented the Louisiana Department of Corrections in an American with Disabilities Act claim.  An investigative officer was found sleeping on the job in an area open to incarcerated felons.  After exhaustive discovery and research on Motion for Summary Judgment, the United States District Court for the Middle District dismissed the former employee’s claims. (Robert Shortess vs. State of Louisiana, Department of Public Safety and Corrections, Elayn Hunt Correctional Center, United States District Court, Middle District of Louisiana, Civil Action No. 07-523-RET)

The Whitehead Law Firm successfully defended a government agency that fired an employee who threatened a co-worker. The employee attempted to hide behind the Americans with Disabilities Act and claimed he suffered from Post-Traumatic Stress Disorder due to his combat service in the military.  Louisiana Courts recognized that a volatile workplace is not to be tolerated.
